By downloading, accessing, or using the VIV application (“VIV”, “the App”), you agree to these Terms & Conditions (“Terms”).

1. What VIV Is

VIV provides educational, informational, and guidance-based content related to training, nutrition, recovery, and lifestyle rhythm, adapted to self-reported inputs (such as cycle phase, sleep, stress, and preferences).

VIV is not:

A medical device
A diagnostic tool
A substitute for professional medical advice
A treatment, therapy, or healthcare service

VIV does not diagnose, prevent, treat, or cure any disease or medical condition.

If you have a medical condition, are pregnant, postpartum, injured, or under clinical care, consult a qualified healthcare professional before using VIV.

2. Eligibility

To use VIV, you must:

Be at least 18 years old
Have legal capacity to enter into this agreement
Use the App for personal, non-commercial purposes only

3. User Responsibility & Self-Assessment

You acknowledge and agree that:

You are responsible for how you interpret and apply guidance from VIV
You decide whether, when, and how to follow any recommendation
You are responsible for listening to your body and stopping activity if something feels wrong

You should not use VIV to override medical advice, ignore symptoms, or push through pain, illness, or injury.

4. Health & Safety Disclaimer (Important)

The App may include guidance related to:

Physical activity and training
Nutrition and food choices
Recovery, sleep, and stress management

All guidance is educational and informational, and does not constitute medical or clinical advice.

If you experience dizziness, pain, shortness of breath, fainting, or any unusual symptoms, stop immediately and seek professional help.

5. Data You Provide

To function, VIV may collect:

Self-reported inputs (e.g. cycle phase, energy, stress, preferences)
App usage data (for performance and improvement)

You confirm that:

The information you provide is accurate to the best of your knowledge
You understand that outputs depend on the quality of your inputs

You remain the owner of the data you provide.

6. No Guarantees

VIV does not guarantee:

Specific results
Performance outcomes
Physical changes
Health improvements

Results vary based on individual factors beyond the App’s control.

7. MVP Status & Feature Changes

You acknowledge that:

VIV is currently an MVP (Minimum Viable Product)
Features, logic, and outputs may change, evolve, or be removed
Temporary bugs, limitations, or inconsistencies may occur

We reserve the right to update or discontinue features at any time.

8. Intellectual Property

All content, logic, text, structure, and branding within VIV are the intellectual property of VIVFEM.

You may not:

Copy, reproduce, distribute, or resell any part of the App
Reverse-engineer or misuse the system or its logic

Personal use only. No commercial exploitation.

9. Limitation of Liability

To the maximum extent permitted by law:

VIV and its creators are not liable for injuries, losses, or damages arising from use or misuse of the App
You use VIV at your own risk

Nothing in these Terms limits liability where such limitation is not permitted under applicable law.

10. Termination

We may suspend or terminate access if:

These Terms are violated
The App is misused
Required by law or platform policy

You may stop using the App at any time.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict of law principles.
